1. Who We Are
Blue Sky Consulting & Advisory Services, Inc., a Florida corporation doing business as Blue Sky Advisory Services (“Blue Sky,” “we,” “us,” or “our”), provides exit planning, value creation, mergers and acquisitions advisory, fractional CFO leadership, and executive recruiting services to business owners. We serve family-owned and owner-operated businesses nationwide across the United States and in Canada.
Our principal place of business is 213 S. Dillard Street, Suite 320E, Winter Garden, FL 34787. Blue Sky is the party responsible for the personal information described in this Policy.
2. Scope of This Policy
This Policy applies to information we collect:
- Through this website and any Blue Sky web page, landing page, form, assessment, or scheduling tool;
- Through email, text message, telephone, and other electronic messages between you and Blue Sky;
- In the course of an advisory, consulting, recruiting, or transaction engagement; and
- From third-party sources, as described in Section 3.
This Policy does not apply to information collected by any third party, including through any third-party website or service you may access through a link on our site. It also does not modify the terms of any signed engagement letter, non-disclosure agreement, or other written contract between you and Blue Sky. Where a signed agreement conflicts with this Policy regarding confidential business information, the signed agreement controls.
3. Information We Collect
3.1 Information you provide to us
We collect information you voluntarily give us, including when you request a consultation, book a call, complete our Owner Readiness Assessment or Business Value Scorecard, subscribe to updates, apply for a role we are recruiting for, or otherwise contact us. This may include:
- Identifiers — name, business name, email address, mailing address, and telephone or mobile number;
- Professional information — your role, industry, years of ownership, and background;
- Business and financial information — revenue, earnings, ownership structure, transaction goals, timing, and similar details you share with us in connection with an engagement or assessment;
- Assessment responses — the answers you select, the score generated, and the readiness categories identified for you;
- Communications — the content of emails, text messages, forms, and call notes; and
- Recruiting information — if you apply through us, your resume, work history, references, and related materials.
3.2 Information collected automatically
When you visit our website, we and our service providers may automatically collect technical information, including your IP address, device and browser type, operating system, referring and exit pages, pages viewed, links clicked, and the dates and times of your visits. This information is used to operate, secure, and improve the site.
3.3 Information from third parties
We may receive information about you from our customer relationship management and marketing platform, scheduling and calendar tools, publicly available sources such as company websites and professional networking profiles, business information databases, and referral partners who introduce you to us.
3.4 Information we do not seek
We do not intentionally collect government-issued identification numbers, financial account credentials, precise geolocation, biometric data, or health information through this website. Please do not submit such information through our web forms. If an engagement requires sensitive information, we will collect it through a secure channel agreed with you.
4. Cookies and Similar Technologies
Our website uses cookies and similar technologies. A cookie is a small text file stored on your device that helps a website function and remember your preferences.
- Strictly necessary cookies keep the site secure and working, and remember choices you make as you navigate.
- Functional cookies support embedded features such as our scheduling widget and embedded video player.
- Analytics and performance technologies help us understand how the site is used so we can improve it.
Embedded content from third parties — including our scheduling and messaging platform and embedded YouTube videos — may set its own cookies and collect usage data under that provider’s own privacy policy. Embedded video is loaded in privacy-enhanced mode where available.
Most browsers let you refuse or delete cookies through their settings. Blocking some cookies may affect how parts of the site work. Because there is no common industry standard for responding to browser “Do Not Track” signals, our site does not currently respond to them; we do, however, honor recognized opt-out preference signals as described in Section 14.
5. How We Use Your Information
We use personal information to:
- Respond to your inquiries and schedule and conduct consultations;
- Deliver your assessment score, results, and related follow-up materials;
- Provide, manage, and improve our advisory, CFO, recruiting, and transaction services;
- Send administrative and transactional messages, including confirmations and appointment reminders;
- Send marketing communications where permitted, subject to your choices in Section 11;
- Operate, secure, troubleshoot, and improve our website and internal systems;
- Analyze usage and measure the effectiveness of our content and outreach;
- Detect and prevent fraud, abuse, and security incidents; and
- Comply with legal, tax, regulatory, and professional obligations, and establish or defend legal claims.
We do not use automated decision-making that produces legal or similarly significant effects about you. Your assessment score is an informational, self-reported indicator and is not a valuation, a credit decision, or professional advice.
6. How We Share Your Information
We do not sell your personal information. We share it only as described below.
- Service providers. Vendors who perform services for us — website hosting, customer relationship management, email and text message delivery, scheduling, analytics, document storage, and professional support — and who are permitted to use the information only to provide those services to us.
- Transaction participants. In the course of an engagement, and with your direction or authorization, we may share information with prospective buyers or sellers, lenders, accountants, attorneys, and other advisors. Where a transaction is involved, disclosure to prospective counterparties is typically made under a non-disclosure agreement.
- Referral partners. If you were introduced to us by a partner, or if we refer you to another professional, we may share limited contact information to make the introduction.
- Legal and safety. When required by law, subpoena, or regulatory authority, or where we believe disclosure is necessary to protect the rights, property, or safety of Blue Sky, our clients, or others.
- Business transfers. In connection with a merger, acquisition, financing, or sale of all or part of our business, subject to this Policy.
- With your consent. For any other purpose you authorize.
We do not share mobile telephone numbers or text-message consent with third parties or affiliates for their own marketing purposes. See Section 7.
7. Text Messaging (SMS/MMS) Program
This section describes the terms of the Blue Sky Advisory Services text messaging program. It applies if you provide your mobile number and consent to receive text messages from us.
7.1 Program description and message types
If you opt in, Blue Sky may send you:
- Conversational messages — one-to-one replies from a member of our team about your inquiry or engagement;
- Appointment messages — confirmations, reminders, and changes for scheduled consultations and meetings;
- Assessment and follow-up messages — your Owner Readiness Assessment or Business Value Scorecard results and related follow-up; and
- Marketing messages — occasional updates, insights, event invitations, and offers, sent only where you have given consent to receive them.
7.2 How you consent
We send text messages only to individuals who have given prior express consent. You may consent by entering your mobile number and affirmatively agreeing on a Blue Sky web form, by providing your number and agreeing in writing or during a conversation with us, or by texting us first. Consent to receive marketing text messages is not a condition of purchasing any product or service from Blue Sky.
7.3 Message frequency
Message frequency varies. Conversational and appointment messages are sent as needed based on your activity and scheduled meetings. Marketing messages, if you have consented to them, are limited and typically do not exceed a small number of messages per month.
7.4 Cost
Message and data rates may apply. Blue Sky does not charge for text messages, but your mobile carrier’s standard messaging and data rates will apply according to your plan. Contact your carrier for details about your plan.
7.5 How to opt out
You may cancel at any time by replying STOP to any message from us. After you send STOP, we will send a single confirmation message and will not send further text messages unless you opt in again. You may also ask us to remove your number by emailing or calling us using the details in Section 21. Opting out of text messages does not remove you from email or postal communications; see Section 11.
7.6 How to get help
Reply HELP to any message for assistance, or contact us using the details in Section 21.
7.7 Carriers and delivery
Message delivery is subject to the transmission limitations of your mobile carrier and is not guaranteed. Mobile carriers are not liable for delayed or undelivered messages. Supported carriers may change at any time, and we are not liable for messages that a carrier fails to deliver.
7.8 Eligibility
You must be at least 18 years old and the account holder of, or authorized to use, the mobile number you provide. If you change or give up your mobile number, please notify us promptly so that we do not message the number’s new holder.
7.9 Privacy of your mobile information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third party except the service providers who deliver messages on our behalf, and those providers are contractually restricted from using the information for any other purpose. This restriction applies to all categories described in this Section 7.
8. Email Communications
We send transactional email — such as assessment results, meeting confirmations, and responses to your inquiries — to individuals who contact us or use our tools. We send marketing email only where permitted by applicable law and your choices. Every marketing email includes an unsubscribe link and our mailing address. Unsubscribing from marketing email does not stop transactional messages related to an active engagement.
9. How Long We Keep Information
We keep personal information for as long as needed for the purposes described in this Policy. In general: inquiry and assessment records are retained while we remain in contact and for a reasonable period afterward; engagement and transaction records are retained for the life of the engagement and for the period required by our professional, tax, and legal obligations; and records of your communication preferences, including opt-out requests, are retained indefinitely so that we can continue to honor them. When information is no longer needed, we delete it or de-identify it.
10. How We Protect Information
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include encrypted connections to our website, access controls limiting information to personnel who need it, and vendor agreements requiring appropriate protections.
No method of transmission or storage is completely secure. We cannot guarantee absolute security, and you share information with us at your own risk. Please do not send confidential financial details or sensitive documents by unencrypted email or through a web form; we will provide a secure channel when one is needed.
11. Your Communication Choices
- Text messages — reply STOP to any message, or contact us. See Section 7.
- Marketing email — use the unsubscribe link in any marketing email, or contact us.
- Telephone — tell us during any call, or contact us in writing, and we will record your preference.
- Cookies — adjust your browser settings as described in Section 4.
We will continue to send messages necessary to an active engagement, and messages we are required to send by law, regardless of marketing preferences.
12. U.S. State Privacy Rights
Depending on where you live, state law may give you rights regarding your personal information. Residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, among others, may have some or all of the following rights:
- Right to know or access — to learn what personal information we have collected about you, the sources, the purposes, and the categories of recipients;
- Right to a copy — to obtain a portable copy of the information you provided to us;
- Right to correct — to have inaccurate personal information corrected;
- Right to delete — to request deletion of personal information, subject to legal and contractual exceptions;
- Right to opt out — of targeted advertising, of the sale or sharing of personal information, and of certain profiling;
- Right to limit — the use and disclosure of sensitive personal information; and
- Right to non-discrimination — we will not deny services, charge different prices, or provide a different level of service because you exercised a privacy right.
How to exercise your rights
Submit a request using the contact details in Section 21. We will verify your identity before responding, typically by confirming information we already hold about you. An authorized agent may submit a request on your behalf with written permission, and we may ask you to verify the agent’s authority. We respond within the time required by applicable law, generally 45 days, and may extend once where permitted.
Appeals
If we decline your request, you may appeal by replying to our response or contacting us at the address in Section 21 with the word “Appeal” in your message. We will respond to appeals within the period required by your state’s law. If your appeal is denied, you may contact your state attorney general.
California Shine the Light
California residents may request information about disclosures of personal information to third parties for those parties’ direct marketing purposes. We do not make such disclosures.
13. Canadian Privacy Rights (PIPEDA & CASL)
If you are in Canada, we handle your personal information in a manner consistent with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.
- Consent — we collect, use, and disclose personal information with your knowledge and consent, except where the law permits otherwise. You may withdraw consent at any time, subject to legal and contractual restrictions and reasonable notice; withdrawing consent may limit our ability to provide services to you.
- Access and correction — you may request access to the personal information we hold about you and ask that it be corrected if inaccurate or incomplete.
- Limited collection — we collect only what is necessary for the purposes identified in this Policy.
- Complaints — you may raise a concern with us using the details in Section 21. If you are not satisfied, you may contact the Office of the Privacy Commissioner of Canada.
Canada’s Anti-Spam Legislation (CASL)
We send commercial electronic messages to Canadian recipients only with express or implied consent as defined by CASL. Every commercial electronic message we send identifies Blue Sky, provides our mailing address and a means of contacting us, and includes a working unsubscribe mechanism that we honor promptly and at no cost to you. You may withdraw consent at any time using that mechanism or by contacting us directly.
Cross-border transfer
Personal information of Canadian residents is stored and processed in the United States by us and our service providers, and may be accessible to U.S. courts and law enforcement under U.S. law. By providing information to us, you acknowledge this transfer.
14. Sale or Sharing of Personal Information
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising. We have not sold or shared personal information in the preceding twelve months, and we do not sell or share the personal information of individuals we know to be under 16 years of age.
Where required by law, we honor recognized browser-based opt-out preference signals, including the Global Privacy Control, as a request to opt out of sale or sharing for the browser or device transmitting the signal.
15. Children’s Privacy
Our website and services are directed to business owners and professionals and are not intended for children. We do not knowingly collect personal information from anyone under 18 years of age, and text messaging requires you to be at least 18. If you believe a child has provided us personal information, contact us and we will delete it.
16. Third-Party Websites and Services
Our website contains links to and embedded content from third-party sites and services, including our scheduling and messaging platform, video hosting, professional networking sites, and documents we publish for download. These third parties operate under their own privacy policies and terms, and we are not responsible for their practices or content. We encourage you to review the privacy policy of any third-party service before providing information to it.
17. Confidentiality of Business Information
We understand that information about your company — its financial performance, ownership, employees, and transaction intentions — is highly sensitive, and that the fact you are exploring a sale may itself be confidential.
Business and financial information you share with us in the course of an engagement is treated as confidential. We disclose it only to those who need it to advance your engagement, and, in a marketed transaction, to prospective counterparties under a non-disclosure agreement, with your authorization. Where you and Blue Sky have signed a confidentiality or engagement agreement, that agreement governs the treatment of your confidential information and takes precedence over this Policy to the extent of any conflict.
18. No Professional Advice
Content on this website, including the Owner Readiness Assessment, the Business Value Scorecard, industry spotlight reports, and general educational material, is provided for informational purposes only. It is directional and self-reported, and it is not a business valuation, a fairness opinion, or legal, tax, accounting, investment, or financial advice. It does not create an advisory or fiduciary relationship. You should consult qualified professionals before acting. See our Disclaimer for additional terms.
19. Accessibility
We work to keep our website usable by as many people as possible, including people using assistive technology. If you encounter a barrier to accessing any part of this site, please contact us using the details in Section 21 and we will work to provide the information you need in an accessible format.
20. Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we do, we will revise the “Last updated” date at the top of this page. If we make material changes, we will provide additional notice, such as a notice on our website or a message to you. Your continued use of our website after an update means you accept the revised Policy.
